I. Introductory Provisions

  1. These contractual terms apply to the purchase and use of a license for the Mango Songbook application on the website www.mangosongbook.com (hereinafter "Application"), operated by Adam Motvička, ID: 74500431 (hereinafter "Operator"), contact email: adam@motvicka.cz.
  2. The application user is any natural or legal person who creates a user account (hereinafter "user"). Creating a user account involves entering an email address and password.
  3. The application is a web service primarily used for storing songs in your own songbook.

II. License Terms

  1. Property rights to the application according to Act No. 121/2000 Coll. on copyright belong to the operator.
  2. The operator hereby grants the user a limited, personal, non-transferable license to use the application.
  3. The subscription can be paid using the Barion payment service - including payment and credit cards. The ordered service will be activated within 1 hour of payment.
  4. Access to the application is ordered for a period of 1 month. After the end of this period, the payment is automatically repeated.

III. User Rights and Obligations

  1. The user undertakes not to use the application in any way that would violate the operator's rights.
  2. The user has no right to lend their login email and password to third parties - accounts are non-transferable, non-sellable, belong only and exclusively to you.
  3. The operator is entitled to prevent the use of the application by a user about whom there is reasonable suspicion that they are violating these contractual terms.
  4. In case of violation of these contractual terms, the operator reserves the right to immediately cancel the user's account and not refund the user's subscription.

IV. Payment for Application Use

  1. Using the application is possible for free. However, with a limited number of songs that the user can add to their songbook. The maximum number of songs in the songbook in the free version is 20.
  2. If the user wants to add more than 20 songs to their songbook, it is necessary to set up an application subscription according to the current price list on the operator's website: Pricing.
  3. With an active subscription, it is possible to add up to 400 songs to the user's songbook.
  4. A proper tax document in electronic form in PDF format is sent to the user at their email address within 24 hours of receiving payment to the operator's account.
  5. The operator reserves the right to change subscription prices at any time. However, any price change will not affect existing users with subscriptions.
  6. The operator reserves the right to announce discounts and other promotions at any time, which it informs about on its website www.mangosongbook.com or in another way.
  7. The operator reserves the right to inform users about news via the specified email. Specifically once a week. The user can unsubscribe from this subscription at any time.

V. Payment Methods for Application Use

  1. Payment for application use can be made through the ComGate service.
  2. The user is entitled to use the application with all its functions unlimitedly for the entire duration of the subscription, without any additional payments.
  3. Access to the application is through the user's email and password. This data is confidential and non-transferable. The user is responsible for keeping this data secret.
  4. The operator reserves the right to change the appearance of the application and expand the application with new functions and modify and change existing functions at any time.

VI. Warranty, Complaints

  1. The provider offers a 100% money-back guarantee within 14 days of purchase (full refund) in case the user is dissatisfied with the service they purchased.
  2. The operator in other respects expressly provides no warranty for the application. The application is provided as offered, without any warranty, whether expressly stated or implied.
  3. All risks associated with using this application are borne by the user. The operator is in no way responsible for damage caused by using the application, whatever it may be.
  4. The operator guarantees that the application works in accordance with its description contained on the mangosongbook.com website. If during the subscription period the user discovers application behavior that contradicts the description on the mangosongbook.com website, they will provide the operator with an accurate description of the identified defect (via support email). In case it is a serious defect that prevents the use of the application, the operator will immediately and free of charge remove the defect.
  5. In case of service unavailability caused by the operator, internet service provider, hacker attacks, force majeure, etc., the operator will do everything to restore the service as soon as possible. In case of unreasonably long outage, the operator will extend the user's subscription by the duration of the outage upon user request.
  6. By ordering a subscription, the user expresses that they have been fully acquainted with the application and its functions.

VII. Personal Data Protection

  1. The operator collects and protects all provided personal data of users in accordance with Act No. 101/2000 Coll., on personal data protection.
  2. Users' personal data will be used only to fulfill the contract with the user and will not otherwise be published or provided to a third party.
  3. By registration, the user gives consent to the collection of information about themselves, only for the administrative needs of the Operator. The user hereby expressly gives consent to store their name, email, and other information relating to the user in the Operator's database. At the same time, they grant consent to send email messages relating to the Mango Songbook application, current subscriptions and related services. The user can unsubscribe from these messages at any time in the footer of each bulk email.

VIII. Final Provisions

  1. By creating a user account, the user agrees to these contractual terms.
  2. These contractual terms apply in the wording stated on the operator's website on the day of user registration and first entry into the application.
  3. These contractual terms may be unilaterally changed by the operator, always with effect after the expiration of a 14-day period from the day of publication of the notice of change of contractual terms on the operator's website https://mangosongbook.com/terms-and-conditions.
  4. These contractual terms are valid from March 1, 2019.
